Glass tenderly captures this relationship with an empathetic gaze that first assumes an ethereal, dreamlike atmosphere - but it isn't long before Maud's dogmatic candor incites an irreconcilable friction that spirals her mind into a suffocating confluence of creeping doubt and paranoia. As Glass tightens the screws on her misguided martyr, well-placed nods are made to religious horror forerunners like William Friedkin's The Exorcist, further contributing to the film's increasingly dread-filled malaise. And when this insidious fever climatically breaks, the consequences are devastating and terrifying in equal measure.

At 17, she was becoming more difficult to deal with. Amanda was beautiful, a straight A student, very active in sports, especially soccer and basketball. She had friends now that I didn’t particularly approve of. There was one girl, Raven, she was into this thing called “Goth”. Straight black hair over one eye, black lipstick and black fingernail polish. Body piercings, always wore black knee high lace up boots and black clothes. Amanda and Raven were so different from one another. I didn’t know how they could be friends. Another girl, Traci, was more like Amanda, bright, beautiful and a lot more normal. I just assumed it was part of being a teenager. Maybe she made friends with Raven just to irradiate me, I don’t know. I was very young when I had Amanda, only 21. I divorced her father when she was 11 and I have tried to be a good mother. I own two retail clothes boutiques which are well managed by my staff. I always had time for Amanda. I was at every basketball and soccer game she played in. Now, at seventeen, I was suddenly in her “space” trying to control her every move. I didn't want a huge mother daughter fight, so I tried to give her room. I was never sure if all her friends were lesbian or not, but really didn’t care. I always allowed the usual teenage sleep overs and didn’t interfere. Weather it was at our house or at someone else’s. On the positive side, I didn't have to worry about her getting pregnant. Boys were not a part of her agenda. It was the start of high school that year, when I met Raven. When I asked Amanda about Raven, I was suddenly controlling her whole life and in her space again. Could it be that this long structure was built by the same mysterious visitors who constructed the money pit, perhaps for the purpose of unloading and burying something of great importance on the Island? Well, there were the raids on portraits. Lewisburg, they lost portraits, Lewisburg to the British before 1746 so I mean, we could look closer at those dates because maybe the fringe, I think we need to look at the need to hide something. So right earlier this year, Naval historian and author chip Reed presented Rick, Marty, Craig, and the team with an astonishing theory, one suggesting that the incredible structures [00:07:00] uncovered at Smiths Cove could be connected to an early 18th century French Ford located some 300 miles Northeast of Oak Island and which contains similar features. [00:07:10] And tunnels. If we look at these structures, I don't know if this structure looks familiar in any way. Well, that's the old shade structure. Yet it was chip Reed's belief that the French, while preparing for a British siege on Lewisburg in 1745 might have secretly moved a vast fortune in golden riches to Oak Island. [00:07:34] For safekeeping a fortune, which following their defeat was never recovered. Could crank testers knows that the wood sample dates back as far as the 1740s provide scientific evidence that she breached theory might be true. They are eager to explore firsthand the 18th century French fortress, which according to Naples historian and author chip Reed has a direct connection to Oak Island and it's 225 year old treasure mystery. [00:10:01] [00:10:00] If there was French Baldman on Oak Island here we have some examples of their engineering undergrads. At the time, the French had completed construction of the fortress at Lewisburg in 1740 it was considered a monument to 18th century military engineering with over two miles of stone walls, which were built as much as 30 feet high and eight feet thick. [00:10:26] But perhaps one of the installations, most compelling features is the vast network of secret tunnels that were constructed beneath it. Tunnels, which Rick and Doug believe may contain design or construction similarities to those found on Oak Island. [00:10:46] We now have two structures on the Island that were quite laborious in terms of their construct, right. Lewisburg wasn't, it started in 1713 and then it falls in [00:11:00] 1745. Well, when you look at the date, so we got through dendrochronology this year, or the end of the warfare, the end of the subway date, the 1741. [00:11:10] You're right in the heyday of Lewisburg. In fact, uh, I believe it was, uh, John Baptist de LA Rochefoucauld called the Duke Danville. It was my understand that's where the Duke dongle is buried. And that's interesting. It is. In 1746 one year after Louisburg fell to British military forces, the French sent a massive Armada to Nova Scotia in an attempt to seize back their conquered fortress led by the Duke dome. [00:11:42] V a member of the same Rochelle called family that boasted direct ties to the Knights Templar. The 97 ship fleet was reportedly carrying a treasure in gold and jewels, presumably in order to finance a local army. [00:12:00] Unfortunately, before the ambitious operation could be carried out, a series of severe storms delayed and plagued the doomed mission typhus and scurvy. [00:12:11] Quickly spread among the soldiers and sailors causing hundreds to die at sea, including the Duke dome V himself. I found eight pages of what looks like a ship's log. According to a recently discovered journal, the Duke's crew after his death was able to hide the treasury was carrying on a wooded Island in Mahoen Bay in hopes of keeping it out of the hands of the British. [00:12:38] It has been agreed that a deep pit dug. The pit to have a secret entrance by a tunnel from the shore, and I mean a great quantity of treasure, and they appear to be in this Bay. A rigging ax dating back to the early 18th century, or even older, commonly kept on board large sailing vessels. Hey, Sarah. Hello. Good to meet you in person. Hey, to meet you in person to welcome to the fortress of Uzbek national historic site assisting Rick and Doug in their investigation is historian Sarah. [00:20:34] McGinnis. It's a beautiful edifice. It's all inspiring. It's really phenomenally gorgeous. Yes. Yeah, and what you see here is actually only one fifth of what it originally was in the 18th century. Sarah. We have some questions that we're trying to answer on the Island. Over the last couple of years, we've uncovered some structures and we've had a Naval his story and tell us [00:21:00] that perhaps they're temporary siege works of sorts. [00:21:03] So we are hoping, perhaps we find something of the similar nature here and we understand yet some tunnels under the Fort and tunnels under undergrad are a big interest. To us and we're hoping to find something that might be similar. Well, hopefully we can find some answers for you. That'd be great. [00:21:19] That'd be fantastic. And what I'd love to do first, so I'd love to see where the Duke Donville is buried. All right, let's go see him first. These people long ago were committed to building this on such a large scale. They did it because they had to, and that's the key enigma of Oak Island. Sometimes you think, Oh, you know, they couldn't have gone down to the bedrock and the money pit area. [00:21:41] They couldn't have tunneled to Smiths Cove. And then you look at this and you realize it is possible. We'll go into the chapel now. This is where the Duke Danville has been. Buried [00:21:55] in 1749 after Louisburg was returned to the French, the [00:22:00] English took the Duke Danville, who is previously buried in what's now Halifax Harbor, and sent his remains here and they were entired under the alter of the chapel [00:22:13] doula rush for cold is the last word. The Rochefoucauld family has been of interest to us the last couple of years because of some other documents we've been looking at on the Island. We're tracing some possibilities that that family may have had some of the answers for which we seek. Not only was the Duke don't V a member of the Roche McAllen family, which in turn had close associates with members of the Knights Templar. [00:22:39] But the name Rochefoucauld is also featured on a mysterious 14th century map of Oak Island given to Rick Lavina by his close friend. The late author and researcher seen a helper. It is one of three maps that were found in an ancient book. And which suggest that the Rochefoucauld's work in some way directly connected to the [00:23:00] Oak Island mystery. [00:23:02] So is there a crypt beneath here that is accessible? Yeah. It's not a crypt as many people would think of it, but there are a number of burials underneath the chapel. One of the things we were hoping to find or see some original works so that we could see it as it was built in the time. Is there anything like that here? [00:23:18] Definitely. [00:23:26] So the case mates were constructed to protect civilians during times of war, and they were one of the only structures that remained standing after the British destroyed the fortress of Lewisburg between 1760 and 1768 so these are the ones you can get an idea of the construction. Whoa, Rick, come and look at this one. [00:23:47] What's your impression of that? [00:23:53] Drain system. That's what caught my eye. Rick. [00:24:02] [00:24:00] Oh yeah, no, we were talking earlier about controlling your water. It goes up to the dry moat, a stone drain system. Could Rick and Doug be looking at the same kind of water flow system that the Oak Island team has found evidence of over the past three years at Smiths Cove? A water flow system known as a French drain? [00:24:27] Certainly one way to run water off, that's for sure. This is very cool. I can't wait to see what you show us next. Alright, let's go look at that. Fortification that you were wondering. Excellent. I just find it exceedingly strange that the drain system in the original fortifications there certainly have an appearance of some of the structures that we saw in Smith's code. [00:24:53] I just found that more than interesting. So the countermind tunnel was constructed [00:25:00] as a means of defending the fortress. So it's that red door down there. It was made so that it could be filled with powder, and if the enemies were approaching, the powder could explode. And cut off enemy attack [00:25:16] dating back as early as the ninth century BC counterminds or a kind of defensive tunnel, commonly utilized in warfare for the purpose of preventing enemy attempts to dig beneath walls or other fortifications. These countermind tunnels would often be rigged. With booby traps such as explosive powder. [00:25:38] Unfortunately, we can't go in because it's home to a back call on me right now. But one neat thing about the countermind tunnel is that is one of the only features that still in the same condition that it was from the 18th century. It was never destroyed and it hasn't been reconstructed, so it's stuck in time. [00:25:55] It's a lot of work when you think about it, because the land is really marshy. It's a good [00:26:00] ways out. So underground. Then. When they built it, the head have a way to manipulate the water. They had to deal with that. A tunnel one that was built through a marshy waterway. Could it be that the same engineering knowledge used to build the countermind tunnel in the surrounding swamp at Lewisburg was also employed in the construction of Oak Island's elaborate network of booby trapped flood tunnels. [00:26:26] It's what we're constantly amazed that. On the work on Oak Island, right. All the tunneling, all the shops. I mean, the amount of work, you know, a tunnel is a tunnel. Digging underground is digging underground. Interesting. To see the plans. We can definitely look into some plans if you're interested. Be very interested. [00:26:43] Oh, let's head out. Great. [00:26:48] We pulled some plans that we thought you'd be interested in, and these actually show the countermind tunnel while visiting on nearly 300 year old French Naval fortress in Lewisburg, Nova [00:27:00] Scotia, Rick Levina and Doug Kroll had been given the opportunity to examine not only the actual plans of the Fort, but also the system of tunnels that exists beneath it. [00:27:12] So the canter, my tunnel is 180 feet and it's in the shape of a cross without, that was fairly interesting. We have a cross on Oak Island, Nolan's cross, which is a. Collection of precisely arranged folders to form a cross toggles laid out in the shape of a cross have written, Doug just found their first piece of concrete evidence connecting this 18th century French Fort to Oak Island, and more specifically to the megalithic structure discovered in 1981. [00:27:52] Known as Nolan's cross, so you don't know if there's an engineered drawing of the tunnel. It's like a, [00:28:00] sorry. No, not that we know of. But there are some images hold. There are, yeah. So it's hard to tell because of the flooding [00:28:14] that's cool. [00:28:20] Oh, it's gorgeous to do that for 190 feet. That's a significant straight as an arrow. Math comes back and do it again. And we've always, we've always wondered, you know, like the tunnel is that problem. Oh, Kyla. And how were they able to do that? Straight as an arrow? I suppose it just depends on the time and precision you want to put into it, but that goes to [00:28:46] Commanding control because look what was achieved here. Visiting Lewisburg was exceedingly interesting. They were able to manipulate water underground, I. E. specifically to create that [00:29:00] tunnel. So what did they know? How did they come to learn of it, I. moving water? They certainly were able to do it. [00:29:10] Could it be done here on the Island? Well, we don't want to take up anymore of your time. You gave us some great takeaways. There's a tunnel right out here that says you can drive a tunnel in a wet environment and keep it dry. That's interesting. Thank you guys for coming. I can't thank you enough. [00:29:33] one day after his visit. To Lewisburg. This is a paved area, right? There were Billy's digging and Rick Levina and his nephew, Alex, arrive at the triangle shape swamp. Now that the area has once again been drained to the point where it is now safe to begin excavating, they are eager to resume this year's plan to fully reveal the mysterious stone paved walkway discovered earlier this [00:30:00] year. [00:30:02] Hey bell. You know dr Spooner is gonna want to come out and take a look at it. As you dig, maybe you might want to swing some of it over there. This one pile is already there and stride. How deep do you want to dig here? I say we dig until we can't dig any deeper. Yeah, [00:30:24] because the recent hurricane has significantly stirred up the bottom of the swamp. And once again, buried the possible stone walkway, the team will have to carefully dredge out several feet of water and muck without damaging the structure. I have to remove myself. Get a cross section of it and look at it and see how deep it really is. I think we all have some hope that it's much bigger because then cleanse itself to the belief that it's manmade [00:31:24] and belly. That's a lot of stones in the side there. We clean this off. Maybe. Something I would think we're looking for flatness too. I'm not sure. I'll get a little more of that brand stuff off and then we'll pick them all out. See what's there. Sounds good. As Billy Gearhart uncovers the Rocky surface now, Alex, Hey, doing geology is Terry Matheson arrived to help identify if the feature is natural or manmade. [00:31:54] Unfortunately, the waters come up. Quite a bit in here, so you can't see the edges as well. Approximately what depth did you [00:32:00] get the boulders? Probably about five feet below that. Maybe a little bit more at the maximum depth. Okay, so those are probably classics. They're not limestone and they're not the gypsum we find deeper, so I'm surprised to see what I think I were taught in counter and about 120 feet downs. [00:32:20] And the money pit area boulders near the surface that would otherwise be found more than 100 feet underground. Has Terry Matheson just identified potential evidence that the stone paved area is manmade? I'm hoping it'll reveal a little bit more of the wall to you. Let's keep digging as is all about. [00:32:50] As another new day begins on Oak Island. Brett, good to see REO. Rick Regina joins his nephew, Alex geoscientists, [00:33:00] doctor and Spooner and heavy equipment operator. Billy Gearhart. At the swamp where they are continuing their efforts to expose the possible stone walkway having located what they believe to be the outer edge of the structure. [00:33:14] The team is now carefully washing away layers of mud and debris that was deposited during the recent hurricane. There was a lot of water. What is the area that you want to see over here in the paves? Hey, I just want to get very a 10 foot long by the whole window. Section, get it clean. See what it looks like. [00:33:34] The paved areas, certainly a well defined target. We want to remove the organics and the sediments and visually inspect the paved area to ascertain whether there's anything there worth investigating. It looks strange to me, illustrates to me too, so we're in agreement. There's something strange. The main thing about it is. [00:33:55] You've got all these rocks that are all fitting together, and my problem is from a geo point of view, [00:34:00] straight geo, all those rocks, that's not common. It's almost as if the rocks were brought in and I don't, don't quite know why that is very strange. That's the paved area right there. It's fairly flat and fairly consistent. [00:34:18] Is this different enough for you to say. This is natural or the hand of man being introduced here. [00:34:32] It's different enough for me to consider that I would like to clean off like a 10 by 20. CFA is exactly what we see here. [00:34:48] The paved area in the swamp is exceedingly interesting. It truly is an unknown. You know, when we go looking for a shaft here and there, we have some background, we [00:35:00] have some history. This thing. As a material lawyers out of the ether. It's quite uniform. It's level. My initial thought is this is indeed manmade. [00:35:14] Having finally exposed a portion of the Pavestone area, a chap, Hey, Gary. Hey Gary. Rick is called archeologist Laird Nivon down to the site to examine it. So that is the feature that we are troubled by right over there. [00:35:34] It doesn't look like any natural formation. It looks like one to you. It looks like if they've been introduced. You didn't think so. I can't see any natural way for it to get here. So you've never seen anything like this before? No. No. Would you finish this? Yeah. I'll get that water moving bell and then you can remove the rest of this. [00:35:57] Yep. [00:36:06] [00:36:00] My mind rounds too. All the work it took to build this paved area. I've done a lot of stone work, myself and my younger days, and uh, this is an enormous undertaking building. It was probably a lot more difficult than it is uncovering this. But we have to uncover it because we need to know what, when, where, why, and how. [00:36:31] And the hope is that we will be able to investigate it. So here's a thing. I don't know what to make of it. I mean, I think we all. To varying degrees of belief that this is something out of the ordinary, but I do know this. It's just made the swap that much more interesting. Absolutely. So to that end, I think tomorrow morning we'll have another go at it and see what it looks like. [00:36:58] Yeah. [00:37:00] There's something stranger. [00:37:08] That's a puzzle. One day after successfully exposing part of the Pavestone feature at the swamp, Rick, Regina and geoscientists, dr Ian Spooner returned to the site to see what else may have been revealed. Now that even more water has been removed, my issue is if this was just dumped. Mike laced or something like that. [00:37:30] It would be piles. It would be a little less horizontal. You'd see these unrelated bit, but it's straight across. You have to have somebody to do it. In my mind, somebody created a surface, you know, I truly want to send my brother some photographs of this and then I, I'll give him a call. I'm sure he's going to ask your opinion. [00:37:52] I'm certain of that. We have the significant mystery ongoing in the swamp. Because the paved area is [00:38:00] proving to be quite a puzzle within a puzzle. They're all, Hey, morning. What's up? I have dr Spooner here, and we're looking at the so-called paved area. I sent you some photographs, which I think you have. [00:38:15] I'll be honest, my eyes and boots perspective, it's manmade. Uh, there's these layers of stone above the tail. That have no clay around them and yet have swamp sediment around them that has to be manipulated. I can't find a natural process that would've led to this. It's a manipulated site. I've worked in these environments and in a similar environment, but it's nothing like this. [00:38:44] To me. It's like. Somebody came in and put the small rocks on the bottom, just like building a road and then put the bigger rocks on top of that so that I think precise. You don't mind on our other flare, [00:39:00] he said. He has no explanation other than it's manmade. [00:39:13] I don't know. Well, if you go seaward we're on a line, like if you have the eye as a excavated site, if you have this paved area as a filled insight, maybe trying to make a platform something solid. And then if you go seaward, you have the deepest portion of the swamp where it was actually an inlet. It all lines up with the peninsula cutting through it. [00:39:40] And so was this some kind of work surface. If people brought boats in a work surface, like a dock possibly used for boats or ships and located in the middle of the Oak Island swamp, could the team have finally on earth definitive proof that this swamp [00:40:00] was artificially created centuries ago and that his ship or sailing vessel was offloaded here and then sung. [00:40:07] In such a way as to hide all evidence. This is why it is a two lane road. No question about that. It looked pretty interesting. Let's try to figure out a purpose for this thing. I can not then. Right. This is not what I expected to see in how clear the interface is and how orderly the stones look as if they're placed. [00:40:32] I have always thought the swamp held some sort of information. Maybe not everything but something. I mean, it's just very strange. It shouldn't be there. Take another profile, and if you find any evidence of disturbance wall there you, Oh yeah, we can. Thank you for the update and I'll be out there all right. [00:40:51] Take care. For Rick. Marty and their team on earthing, what appears to be a manmade stone [00:41:00] platform or warm in the middle of the swamp is nothing short of historic breakthrough discovery. One that may prove to be just as critical to solving the Oak, either mystery as finding the original money pit, but who built it when and for what purpose. [00:41:19] Those are the questions that weren't answered. Might very well provide the keys to solving the entire Oak Island mystery and could in turn. Ordinary love movie. Ordinary love dvd. Ordinary love bass tabs. 'Ordinary Love (2019) is exactly what it says on the tin: a portrait of mundane, turbulent, beautiful love. It charts the journey of a couple moving through tough times and is as thoughtful and nuanced as you'd hope. Its story is rather straightforward (it's pretty much exactly what you'd expect) but it delivers what it needs to and feels all the more 'real' because of it. The focus of the film is something that isn't actually explored all that often and it's great to see it portrayed so sensitively here. The picture's grounded, non- romanticised' romance is brilliant, too. It feels as close to 'real' as possible, an honest and moving exploration of love that never seems heightened or false. The two stars deliver the goods in their subtle, harder-than-you-may-expect roles, coming together as a compelling pair of, essentially, real people. They have flaws and they argue but they also have an undeniable connection. When this is exploited, it's really heart-warming. When it comes down to it, though, the flick just isn't all that exciting or, perhaps, impactful. It's engaging enough and never even close to boring, but it doesn't quite hit home as hard as it ought to. It's good, don't get me wrong. I can't quite put into words what it is that it is, for me, missing. I guess I'll say it like this: it's good, but it's not great. 6/10.

The relationship described is convincing and the emotions as the cancer theme develops, raw and realistic. The two leads are excellent, but this is a Lesley Manville's film, I would say. She should get nominated for something. It is hard to think of a major actress with a wider range. Most beautiful song ever. Perfect. I keep crying. Ordinary love john legend. Sometimes keeping a film simple and not overdoing it with dramatic music or big set plays actually allows a film to resonate to a larger extent and that's certainly the case here. A reminder that Neeson is actually quite the versatile actor with the right material and a powerful lead alongside him. Emotional and a story that will likely effect most of us at sometime an intelligent, respectful yet all the powerful for it film that did not overstate or understate in any department but struck the perfect tone. Not necessarily for everyone but I for one thought it was fantastic. The most beautiful woman I have ever seen in my seen her in beauty, grace,humbleness and voice is what makes me love her music the way I do. Ordinary love u2 jimmy fallon. Ordinary love alaine. Doctor who cast. ”To be fair, they cut out all the jokes.” Love that line, and this line, ”I will stop you, Ill stop all of you!”.

Make what you will of the pilot episode of the new Doctor Who. I myself was fairly dubious upon first viewing, yet by the second episode, Russell T Davies had established a mark that makes this series his own! Gone are the wobbly sets and loose plots without continuity. Despite the episodes being manned by several writers, Davies manages to ingeniously weave them together. From the very first episode, he leaves the slight inkling of an epic subplot; the Doctor's heartfelt, almost-apologetic excuse to the Nestene Consciousness ( I couldn't save your world - I couldn't save ANY of them) is incredibly engaging and it was this very line that drew me in to offer the series a second chance.
And I'm incredibly glad I did. The series takes everything that made the original series popular and updates it for a new generation. The villains, the ideals and the themes all reflect a world that people are living in today. And then Davies also adds something new to the character of the Doctor - a REAL mythology. He no longer has that familiar skip in his step that he was famous for - he's running on low battery power - and he has something no other Doctor had; a survivor's guilt. A man left homeless by an epic war between an ancient and familiar enemy. He carries both the burden of the loss of his home and people, but also the guilt that he somehow had a hand in it.
This subplot runs through the course of the series and works incredibly well; that no matter how random the location or episode plot, beneath it lays that familiar drive that is guiding the audience toward the two-part finale. And what a finale! Not to spoil it for those who haven't seen the series, but everything regarding the Time War comes to an explosive crescendo and at long last the Doctor appears to be able to put his demons to rest.
And then there's Rose! Well, I thought she was amazing and such a well-rounded character. You can believe her and the fact that she is very much our eyes and ears on both the Doctor and the life he gives her makes her even more endearing. But what sets her out from her predecessors (as with the Doctor) is she has a mythology of her own. A life, a family, a home - and Davies taps into those unanswered questions from the old series excellently. What happens to her life away from the Doctor? Do her friends and family miss her? Will she come back? If anything, Rose is just as important as the Doctor. They have the electrifying chemistry that bristled with Lois Lane and Clark Kent, Mulder and Scully and all the other great "Will-they/won't-they" characters. With some shows, pairing off the characters kills off a program, but with these - you almost feel that it would only take the future plots and scenes even further! This series is fantastic - despite its one of two slight hiccups (Episodes 4/5. and it is clear that both Davies and the BBC have taken slight influences from popular sci-fi shows such as Buffy and Angel. Though, this is in no way a criticism. If you want to be the best, you have to study the best. Adapting the story arc (episode 6) placing a Big Bad to the forefront of the series and throwing in an enigmatic hook (Bad Wolf) gives the show an excellent feel of continuity and does not feel out of place in today's society.
The Doctor's back - and he's here to stay! and PS - things, in my opinion, look VERY promising with Mr. Tennant...

A pardon may be granted before or after conviction for the crime, depending on the laws of the jurisdiction. [1] [2] Pardons can be granted in many countries when individuals are deemed to have demonstrated that they have "paid their debt to society", or are otherwise considered to be deserving of them. Pardons are sometimes offered to persons who were either wrongfully convicted or who claim that they were wrongfully convicted. In some jurisdictions of some nations, accepting a pardon may implicitly constitute an admission of guilt; the offer is refused in some cases. Cases of wrongful conviction are in recent times more often dealt with by appeal rather than by pardon; however, a pardon is sometimes offered when innocence is undisputed in order to avoid the costs that are associated with a retrial. Clemency plays a critical role when capital punishment is applied. Pardons are sometimes seen as a mechanism for combating corruption, allowing a particular authority to circumvent a flawed judicial process to free someone that is seen as wrongly convicted. Pardons can also be a source of controversy. In extreme cases, some pardons may be seen as acts of corruption by officials in the form of granting effective immunity as political favors. By country [ edit] Australia [ edit] In Australia, the traditional pardon power is referred to as the royal prerogative of mercy, [3] an executive power that is vested in the Queen and may be exercised by the Governor-General. [4] The prerogative of mercy is a broad discretionary power that may be exercised by a state governor who is acting on the advice of the state executive council and the state attorney general. [5] Courts in Australia may also exercise their traditional power to exercise mercy when the circumstances of the defendant or offense warrant relief. [6] In addition to the prerogative of mercy, Australia has passed legislation that creates additional avenues to seek a pardon, exoneration, reduced sentence, [7] or conditional release. [8] [9] Canada [ edit] Pardons [ edit] The Parole Board of Canada (PBC) is the federal agency responsible for making pardon decisions under the Criminal Records Act (CRA). Under the CRA, the PBC can issue, grant, deny, and revoke pardons. In 2012, the Parliament of Canada passed the Safe Streets and Communities Act, [10] which changed many of elements regarding the criminal justice system. The Act replaced the term "pardon" with "record suspension", [11] and the pardon system was similarly changed. [12] A pardon keeps the police record of a conviction separate and apart from other criminal records, and gives law-abiding citizens an opportunity to reintegrate into Canadian society. The RCMP removes all information about the conviction for which an individual received the pardon from the Canadian Police Information Centre (CPIC). Federal agencies cannot give out information about the conviction without approval from the Minister of Public Safety Canada. A pardon does not, however, erase the fact that an individual was convicted of a crime. The criminal record is not erased, but it is kept separate and apart from other (non-pardoned) criminal records. A pardon removes disqualifications caused by a criminal conviction, such as the ability to contract with the federal government, or eligibility for Canadian citizenship. If an individual in receipt of a pardon is convicted of a new offence, the information may lead to a reactivation of the criminal record for which the pardon was received in CPIC. A pardon does not guarantee entry or visa privileges to another country. Before travelling to another country, individuals must still contact the authorities of the country in question to find out what the requirements are to enter that country. Processing of pardons by the Parole Board of Canada generally takes six months for a summary offence and twelve months for an indictable offence. If the Parole Board proposes to deny the application, it can take 24 months to process. [17] Clemency [ edit] In Canada, clemency is granted by the Governor-General of Canada or the Governor in Council (the federal cabinet) under the royal prerogative of mercy. Applications are also made to the National Parole Board, as in pardons, but clemency may involve the commutation of a sentence, or the remission of all or part of the sentence, a respite from the sentence (for a medical condition) or a relief from a prohibition (e. g., to allow someone to drive who has been prohibited from driving). Chile [ edit] In Chile, the institution of pardon ( indulto) is regulated in the Criminal Code (article 93, Nº 4º), [18] which deals with the extinction of criminal liability. If granted, the decree of pardon is signed by the President, the Prime Minister, the Minister of Justice, and possibly other ministers involved in the consideration of the case. The Parliament of France, on occasions, grants amnesty. This is a different concept and procedure from that described above, although the phrase "presidential amnesty" ( amnistie présidentielle) is sometimes pejoratively applied to some acts of parliament traditionally voted upon after a presidential election, granting amnesty for minor crimes. The governance in the centre and states is carried out in the name of the president and governor respectively. Article 72 says that the president shall have the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence. The meaning of these terms is as follows: The pardoning powers of the Indian President are elucidated in Art 72 of the Indian Constitution. There are five different types of pardoning which are mandated by law. Pardon: means completely absolving the person of the crime and letting him go free. The pardoned criminal will be like a normal citizen. Commutation: means changing the type of punishment given to the guilty into a less harsh one, for example, a death penalty commuted to a life sentence. Reprieve: means a delay allowed in the execution of a sentence, usually a death sentence, for a guilty person to allow him some time to apply for Presidential Pardon or some other legal remedy to prove his innocence or successful rehabilitation. Respite: means reducing the quantum or degree of the punishment to a criminal in view of some special circumstances, like pregnancy, mental condition etc. Remission: means changing the quantum of the punishment without changing its nature, for example reducing twenty year rigorous imprisonment to ten years. Article 72 reads: (1) The President shall have the power to grant pardons, reprieves, respites or remission of punishment or to suspend remit or commute the sentence of any persons convicted of any offence- (a) in all cases where the punishment or sentence is by a court martial; (b) in all cases where the punishment or sentence is for an offence against any law relating to a matter to which the executive power of the Union extends; (c) in all cases where the sentence is a sentence of death. (2) Nothing in sub- clause (a) of clause (1) shall alter the power conferred by law on any officer of the Armed Forces of the Union to suspend, remit or commute a sentence passed by a Court Martial. (3) Nothing in sub-clause (c) of clause (1) shall affect the power to suspend remit or commute a sentence of death exercisable by the Governor of a State under any law for the time being in force. Similarly, as per article 161: Governor of a State has the power to grant pardons, reprieves, respites or remissions of punishment or to suspend, remit or commute the sentence of any person convicted of any offence against any law relating to a matter to which the executive power of the state extends. Please note that President can grant pardon to a person awarded death sentence. But a governor of a state does not enjoy this power. The question is whether this power to grant pardon is absolute or this power of pardon shall be exercised by the President on the advice of Council of Ministers. The pardoning power of the president is not absolute. It is governed by the advice of the Council of Ministers. This has not been discussed by the constitution but is the practical truth. Further, the constitution does not provide for any mechanism to question the legality of decisions of President or governors exercising mercy jurisdiction. But the SC in Epuru Sudhakar case has given a small window for judicial review of the pardon powers of President and governors for the purpose of ruling out any arbitrariness. The court has earlier held that court has retained the power of judicial review even on a matter which has been vested by the Constitution solely in the Executive. However, it is important to note that India has a unitary legal system and there is no separate body of state law. All crimes are crimes against the Union of India. Therefore, a convention has developed that the governor's powers are exercised for only minor offenses, while requests for pardons and reprieves for major offenses and offenses committed in the Union Territories are deferred to the President. Both the President and Governor are bound by the advice of their respective Councils of Ministers and hence the exercise of this power is of an executive character. It is therefore subject to Judicial Review as held by the Supreme Court of India in the case of Maru Ram v. Union of India [1980] INSC 213, 1981 (1) SCC 107, Supreme Court. It was subsequently confirmed by Kehar Singh v. Union of India [1988] INSC 370, 1989(1) SCC 204, Supreme Court. In the case of Epuru Sudhakar & Anr vs Govt. Of A. P. & Ors [2006] INSC 638, Supreme Court, it was held that "clemency is subject to judicial review and that it cannot be dispensed as a privilege or act of grace". The court made these observation while quashing the decision of then Governor of Andhra Pradesh Sushil Kumar Shinde in commuting the sentence of a convicted Congress activist. [23] Iran [ edit] In the Islamic Republic of Iran, the Supreme Leader has the power to pardon and offer clemency under Article 110, § 1, §§ 11. Ireland [ edit] Constitutional basis [ edit] The Irish constitution states (in Article 13. 6) that The right of pardon and the power to commute or remit punishment imposed by any court exercising criminal jurisdiction are hereby vested in the President, but such power of commutation or remission may also be conferred by law on other authorities. The power of clemency is nominally exercised by the president. However, the President of Ireland must act "on the advice" of the Government (cabinet), so in practice the clemency decisions are made by the government of the day and the president has no discretion in the matter. The responsibility can also be delegated to people or bodies other than the president. Amnesty and immunity, on the other hand, are usually dealt with by an Act of the Oireachtas rather than by a general form of pardon or a slate of individual pardons. There are two methods by which a pardon may proceed: Method I [ edit] In the first procedure, aimed at miscarriages of justice, the Minister for Justice may recommend to the Government that they formally advise the President to grant a pardon, and any conditions along with it. 1993 Criminal Procedure Act provides the method by which a person convicted of an offense may apply for a pardon. Under this procedure, the person must: Have already been convicted. Have used up their appeals. Allege a new fact (previously known and believed to be significant, but which he has a reasonable excuse for not having mentioned) or newly discovered fact (including a fact previously known which was not believed to be significant) showing a miscarriage of justice has taken place. Then they can apply in writing to the Minister for Justice for a pardon. The minister may then "make or cause to be made such inquiries as they consider necessary" and may refuse to grant the pardon on his/her own initiative, or if they think the person should be pardoned, bring such argument to cabinet. Method II [ edit] Section six of the act allows a Minister for Justice to seek or receive a pardon request from someone whose case is not a 'miscarriage of justice', but has some other fault, such as an archaic law, a law being misapplied by a rogue judge, a reduction in the harshness of a sentence or a substitution of a sentence, without having to go through the procedure above, gone through appeals, or presented new facts. It also allows the minister to waive the procedure in a case of miscarriage of justice if the specific case warrants it. It may also allow prospective pardons as it allows the minister to pardon someone who has not been convicted yet, which the other procedure requires. Committee of Inquiry [ edit] The government itself may assemble a committee to study the case in more detail on their behalf. This may consist of anyone, and any number, but the chair must be: A judge or former judge or A barrister of at least 10 years standing or A solicitor of at least 10 years standing. This special committee may look to any material it sees fit to make its decision, even if it was not, or would not be, available to a jury or trial judge in a normal court. The government do not have to be bound by the committee recommendations. Pardons under Military Law [ edit] Under Section 7(5) of the act, the same powers of the Minister for Justice apply to the Minister for Defense in the case of military officers and enlisted convicted by courts martial. Compensation [ edit] The Minister for Justice or Defense may also, in their absolute discretion, pay compensation, determined by them alone, to any person given a pardon, if this compensation is applied for. If they think the compensation is too low they may challenge for a higher figure in the High Court. List of people who have received a presidential pardon since 1938 [ edit] The power is used very infrequently compared to, for example, pardons in the United States. [24] 1940 – Thomas Quinn, granted by Douglas Hyde 1943 – Walter Brady, granted by Douglas Hyde 1992 – Nicky Kelly, granted by Mary Robinson 1999 – William Geary, granted by Mary McAleese Israel [ edit] In Israel the President has the power to pardon criminals or give them clemency. The pardon is given following a recommendation by the Minister of Justice. After the Kav 300 affair, President Chaim Herzog issued a pardon to four members of the Shin Bet prior to them being indicted. This unusual act was the first of its kind in Israel. Italy [ edit] In Italy, the President of the Republic may "grant pardons, or commute punishments" according to article 87 of the Italian Constitution. Like other acts of the president, the pardon requires the countersignature of the competent government minister. The Constitutional Court of Italy has ruled that the Minister of Justice is obliged to sign acts of pardon. [25] The pardon may remove the punishment altogether or change its form. Unless the decree of pardon states otherwise, the pardon does not remove any incidental effects of a criminal conviction, such as a mention in a certificate of conduct (174 c. p. ) or the loss of civil rights. According to article 79 of the Italian Constitution the Parliament may grant amnesty (article 151 c. ) and pardon (article 174 c. ) by law deliberated a majority of two-thirds of the components. The last general pardon, discounting 3 years from sentences, was approved in 2006. Poland [ edit] In Poland, the President is granted the right of pardon by Article 139 of the Constitution of the Republic of Poland. As of October 2008, 7, 819 people were pardoned, while 3, 046 people's appeals were declined. Lech Wałęsa Approved – 3, 454 Declined – 384 Aleksander Kwaśniewski Approved – 3, 295 (the first term); 795 (the second term); total – 4, 090 Declined – 993 (the first term); 1, 317 (the second term); total – 2, 310 Lech Kaczyński (until October 2007) Approved – 77 Declined – 550 Bronisław Komorowski Approved – 219 Declined – 189 Portugal [ edit] In Portugal, the Heads of State, Kings or Presidents, have always enjoyed the prerogative of grace, being able to grant pardons, commuting or extinguishing sentences in the context of requests for clemency. According to the Portuguese Constitution [26], the President of the Portuguese Republic has the power to pardon and commute sentences, on the proposal of the Government of the Portuguese Republic. This is the exclusive and discretionary competence of the President and is not subject to any conditions beyond the prior hearing of the Government, generally represented by the Minister of Justice. Requests or proposals for pardons are instructed by the Criminal Execution Court by referral from the Ministry of Justice and subsequently submitted to the President for consideration. The pardon is granted by Presidential Decree; if the pardon is denied, the President decides by order. Traditionally pardons are granted during the Christmas period. The pardon can be revoked by the President of the Republic. In 2019 the President granted two pardons. [27] The pardon, as an individual, shall not be confused with amnesty or generic forgiveness, both of a general and abstract nature. Amnesty has retroactive effects, affecting not only the penalty applied but the past criminal act itself, which is forgotten, considered as not practiced (retroactive abolition of crime). Generic forgiveness focuses only on the penalties determined by the sentencing decision and for the future. It is the reserved competence of the Portuguese Parliamnent to approve generic amnesties and pardons. [28] Russia [ edit] The President of the Russian Federation is granted the right of pardon by Article 89 of the Constitution of the Russian Federation. The chain of pardon committees manage lists of people eligible for pardon and directs them to the President for signing. While President Boris Yeltsin frequently used his power of pardon (1998 – 7, 000 to 8, 000 cases), his successor Vladimir Putin is much more hesitant; he granted five pardons in 2014 and two in 2015. [29] Pardon can be requested in any time. The next request can be submitted one year after the previous one. [30] Rwanda [ edit] The prerogative of mercy is a form of pardon that can be exercised by the President of Rwanda. The prerogative is one of the powers of the president defined by the Constitution of Rwanda, which came into effect in 2003 following a national referendum. [31] According to the Constitution of Rwanda, "The President of the Republic has authority to exercise the prerogative of mercy in accordance with the procedure determined by law and after consulting the Supreme Court on the matter. " [32] Republic of South Africa [ edit] Under section 84(2)(j) of the Constitution of the Republic of South Africa, 1996 (Act 108 of 1996), the President of the Republic of South Africa is responsible for pardoning or reprieving offenders. This power of the President is only exercised in highly exceptional cases. To pardon a person is to forgive a person for his/her deeds. The pardon process is therefore not available to persons who maintain their innocence and is not an advanced form of appeal procedure. Pardon is only granted for minor offences after a period of ten years has elapsed since the relevant conviction. For many serious offences (for example if the relevant court viewed the offence in such a serious light that direct imprisonment was imposed) pardon will not be granted even if more than ten years have elapsed since the conviction. Spain [ edit] The derecho de gracia ("right of grace") or indulto ("pardon") is acknowledged by the Spanish Constitution of 1978 as a privilege of the King of Spain (article 62. i: "Functions of the King"). The Spanish Constitution defines it as a renounce on the State's part of its own punitive power on behalf of an individual, founded on reasons of equity or public interest. The Constitution subjects royal pardons to the Law and forbids general pardons, so they have to be granted individually. Theoretically, a royal pardon can be granted for a general offense or accessory offenses alone; if it is granted for a general offense, the accessory ones it implies are also pardoned, with the exception of punishments involving political rights (i. e., removal of the right to run for a public office as a result of a sentence), which have to be explicitly mentioned in the pardon decree if they are going to be pardoned. The procedure and requirements for the grant of the pardon are given by the Law of 18 June 1870, modified by the Law 1/1988 of 14 January. The application for royal pardon has to be carried out by the convicted person himself, his relatives or any other person in his name. The convicting court will then issue a report of the case, which shall be considered along with the public comments of the Prosecutor and the victims of the crime if there were any. All of this is gathered by the Minister of Justice, who will present the pardon issue to the Cabinet of Ministers. If the Cabinet decides a pardon should be granted, then the Minister of Justice will recommend as such to the King. Pardons are issued by Royal Decree and have to be published in the Boletín Oficial del Estado ("Public Journal"). Pardons are not commonly conceded in Spain but for offenders convicted for minor crimes who are about to complete their sentence and have shown good behaviour and repentance. Dating back to medieval times, several organisations and religious brotherhoods still hold the right of granting pardons as part of some privilege or other granted to them by the King of Spain. The scope of this privilege depends on the royal charter received by the organisation when their right to concede pardons was granted, though it usually holds only for minor offenses in very especial conditions; this right is implicitly acknowledged by the public offices nowadays, though it is not exercised but following the usual procedure for royal pardons. Traditionally, they will propose some petty criminal about to end his sentence for pardon being granted to him, and he/she will be released following the tradition to which the pardon holds, usually during the Holy Week. This type of pardons are distinguished from the usual ones in that they only release the prisoner from jail, halting the sentence, but do not pardon the offense itself. Sri Lanka [ edit] In Sri Lanka, under the Sri Lankan Constitution the President can grant a pardon, respite or substitute a less severe form of punishment for any punishment imposed to any offender convicted of any offence in any court within the Republic of Sri Lanka. It is generally referred to as a Presidential pardon. Switzerland [ edit] In Switzerland, pardons may be granted by the Swiss Federal Assembly for crimes prosecuted by the federal authorities. For crimes under cantonal jurisdiction, cantonal law designates the authority competent to grant pardons (if any). In most cantons, the cantonal parliament may pardon felonies, and the cantonal government may pardon misdemeanors and minor infractions. Turkey [ edit] The president of Turkey is granted the right of pardon under certain circumstances defined in the constitution, article 104. According to the article, the president can "remit, on grounds of chronic illness, disability, or old age, all or part of the sentences imposed on certain individuals". After the convict's or his or her proxy's application, if the Council of Forensic Medicine determines that the convict suffers from chronic illness, disability, or old age, the Ministry of Justice presents the situation to the president, and the president can choose to grant a pardon. Additionally, the parliament of Turkey has the power to announce general amnesty. United Kingdom [ edit] The power to grant pardons and reprieves in the United Kingdom is known as the royal prerogative of mercy. It was traditionally in the absolute power of the monarch to pardon an individual for a crime, whether or not he or she had been convicted, and thereby commute any penalty; the power was then delegated both to the judiciary and the sovereign's ministers. Since the creation of legal rights of appeal, the royal prerogative of mercy is no longer exercised by the person of the sovereign, or by the judiciary, but only by the government. In constitutional terms, under the doctrine of the rule of law, the power of ministers to overrule the judiciary by commuting criminal sanctions imposed resolves different and sometimes conflicting public interests. In civil matters, only the legislative branch, and not ministers, have the power to override the judiciary. Until the nineteenth century, for many crimes the sentence was mandatory and was formally pronounced in court immediately upon conviction, but judges and ministers were given powers to exercise the royal prerogative of mercy out of court, in order to mitigate the rigour of the law. Before there was any general form of criminal appeal, a judge might grant a pardon either by way of clemency, because he felt in his opinion that the law was unduly harsh (for example, in the case of convictions of minors), that the verdict was dubious, to seek public approval, or it was otherwise in the public interest. Capital sentences imposed by the assizes were generally executed when the assize was concluded and as the circuit judge left the town, so there was a limited window of time to apply to a judge or directly to the Crown for a pardon. Especially for assizes that were far away from the then capital and major cities of London, York, Durham, Edinburgh, or Dublin, a pardon might well arrive too late. Perhaps as a form of temporary punishment, to give solace, to avoid public disorder, to consult or obtain further evidence, or to maximise the public approval of the King's mercy, judges often did not grant their pardons until their departures; the convict often hoped until his last moments that the sentence of death would not actually be executed, and it was generally popular for a reprieve to arrive at the scaffold at the very moment of the execution. [33] Conditional pardons were granted to many in the 18th century, in return for transportation to British colonies overseas for life in lieu, especially to the Australian colonies. The first known general pardon in post- Conquest England was issued during the celebrations at the coronation of King Edward III in 1327. In 2006, all soldiers from England, Wales, Scotland, and Ireland who were executed for cowardice during the First World War were given a statutory pardon by an Act of Parliament (the Armed Forces Act 2006), resolving a long-running controversy about the justice of their executions. [34] Today the sovereign only grants pardons upon the advice of her ministers: currently they are the Lord Chancellor, for England and Wales; [ citation needed] the First Minister of Scotland; [ citation needed] or the Secretary of State for Northern Ireland. [ citation needed] The Secretary of State for Defence is responsible for military cases. [ citation needed] It is the standard policy of the government to only grant pardons to those who are considered "morally" innocent of the offence, as opposed to those who may have been wrongly convicted by a misapplication of the law. [ citation needed] Pardons are generally no longer issued prior to a conviction, but only after the conviction. The use of the royal prerogative of mercy is now a rare occurrence, given that the Criminal Cases Review Commission and the Scottish Criminal Cases Review Commission are now avenues to statutory remedies against miscarriages of justice. Therefore, the grant of pardons is now very rare occurrence indeed, and the vast majority of acknowledged miscarriages of justice were decided upon by the courts. During the Birmingham Six case, Home Secretary Douglas Hurd stressed that he could only make the decision for a pardon if he was "convinced of [their] innocence", which at the time he was not. [35] One recent case was that of two drug smugglers, John Haase and Paul Bennett. They were pardoned in July 1996 from their sentences of imprisonment both of 18 years, having served some ten months, on the advice of Home Secretary Michael Howard. [36] This was intended as a reward for their information given to the authorities, but there were speculations as to the motives of the Home Secretary. [37] In 2008 they were sentenced to imprisonment for 20 and 22 years, respectively, after subsequent discovery that the information they gave was unreliable. In 1980, after the courts had dismissed their appeals, the Home Secretary, William Whitelaw, used the royal prerogative of mercy to free David Cooper and Michael McMahon from their imprisonment, both having been convicted of murder on poor evidence. [38] [39] Under the Act of Settlement 1701, a pardon cannot prevent a person from being impeached by Parliament, but a pardon may commute any penalties imposed for the conviction. In England and Wales no person may be pardoned for an offence under Section 11 of the Habeas Corpus Act 1679 (unlawfully transporting prisoners out of England and Wales). [40] United States [ edit] U. S. Constitution [ edit] In the United States, the pardon power for offenses against the United States is granted to the President of the United States under Article II, Section 2 of the United States Constitution which states that the President "shall have power to grant reprieves and pardons for offenses against the United States, except in cases of impeachment ". The U. Supreme Court has interpreted this language to include the power to grant pardons, conditional pardons, commutations of sentence, conditional commutations of sentence, remissions of fines and forfeitures, respites, and amnesties. [41] The pardon power of the President applies only to convictions under federal law. [42] Additionally, the power extends to military court-martial cases, as well as convictions in the Superior Court of the District of Columbia. [42] Almost all pardon petitions are addressed to the President, who grants or denies the request. In some cases, the President will, of his own accord, issue a pardon. [43] Typically, applications for pardons are referred for review and non-binding recommendation by the Office of the Pardon Attorney, an official of the United States Department of Justice. [44] State law [ edit] The governors of most U. states have the power to grant pardons or reprieves for offenses under state criminal law. In other states, that power is committed to an appointed agency or board, or to a board and the governor in some hybrid arrangement (in some states the agency is merged with that of the parole board, as in the Oklahoma Pardon and Parole Board). [45] Nine states in the United States have boards of pardons and paroles that exclusively grant all state pardons. These states are: Alabama (Board of Pardons and Paroles), Connecticut (Board of Pardons and Paroles), Georgia ( Board of Pardons and Paroles), Idaho (Commission of Pardons and Paroles), Minnesota ( Board of Pardons), Nebraska (Board of Pardons), Nevada (Board of Pardon Commissioners), South Carolina ( Board of Probation, Parole and Pardon), and Utah (Board of Pardons and Parole). On at least three occasions, state governors— Toney Anaya of New Mexico in 1986, [46] George Ryan of Illinois in 2003, [47] and Martin O'Malley of Maryland in 2014 [48] —have commuted all death sentences in their respective states prior to leaving office. [ edit] These terms differ subtly from country to country, but generally: [49] [50] [51] Clemency is a general concept of amelioration of penalties, especially by action of executive officials; the forms it may take include the following: Amnesty: A pardon applied to a group of people rather than an individual. President Jimmy Carter offered amnesty to anyone who had evaded the draft. Weapon amnesties are often granted so that people can hand in weapons to the police without any legal questions being asked as to where they obtained them, why they had them, etc. After a civil war a mass amnesty may be granted to absolve all participants of guilt and "move on". Amnesties are typically applied in advance of any prosecution for the crime. Commutation: Substituting the imposed penalty for a crime with a lesser penalty, whilst still remaining guilty of the original crime (e. g., someone who is guilty of murder may have their sentence commuted to life imprisonment rather than death, or the term of imprisonment may be reduced). Remission: Complete or partial cancellation of the penalty, whilst still being considered guilty of said crime (i. e., reduced penalty). Also known as remand, the proceedings by which a case is sent back to a lower court from which it was appealed, with instructions as to what further proceedings should be had. Reprieve: Temporary postponement of a punishment, usually so that the accused can mount an appeal (especially if he or she has been sentenced to death). [52] Respite: The delay of an ordered sentence, or the act of temporarily imposing a lesser sentence upon the convicted, whilst further investigation, action, or appeals can be conducted. Expungement: The process by which the record of a criminal conviction is destroyed or sealed from the official repository, thus removing any traces of guilt or conviction. Immunity from prosecution: A prosecutor may grant immunity, usually to a witness, in exchange for testimony or production of other evidence. The prosecutor (conditionally) agrees not to prosecute a crime that the witness might have committed in exchange for said evidence. For example, a car thief who witnesses a murder might be granted immunity for his crime as an inducement to identify, and perhaps to truthfully testify against the murderer. Other immunity: Several other types of immunity are available, depending on the status of a person as a member of the government. [ vague] Some criminals who testify for the prosecution put their life in jeopardy by doing so. To encourage witnesses to testify, the government may offer witness protection. In the United States Federal Witness Protection Program, about "95% of [witnesses in the program] are... criminals. " [53] Those who testify for the prosecution may be offered immunity from prosecution for their own crimes. The reason Frost is one of the most liked poets in the English language is because his poems are often very simple, and he meant them to be, despite that you can understand them on different levels. The poem starts out telling about two roads diverging in the woods before a traveler. The traveler spends some time (we don't know exactly how much, but some) examining the roads before deciding to take the one that looks less traveled by. Robert Frost | Source Robert Frost And A Summary of The Road Not Taken "The Road Not Taken" is an ambiguous poem that allows the reader to think about choices in life, whether to go with the mainstream or go it alone. If life is a journey, this poem highlights those times in life when a decision has to be made. Which way will you go? The ambiguity springs from the question of free will versus determinism, whether the speaker in the poem consciously decides to take the road that is off the beaten track or only does so because he doesn't fancy the road with the bend in it. External factors therefore make up his mind for him. Robert Frost wrote this poem to highlight a trait of, and poke fun at, his friend Edward Thomas, an English-Welsh poet, who, when out walking with Frost in England would often regret not having taken a different path. Thomas would sigh over what they might have seen and done, and Frost thought this quaintly romantic. In other words, Frost's friend regretted not taking the road that might have offered the best opportunities, despite it being an unknown. Frost liked to tease and goad. He told Thomas: "No matter which road you take, you'll always sigh and wish you'd taken another. " So it's ironic that Frost meant the poem to be somewhat light-hearted, but it turned out to be anything but. People take it very seriously. It is the hallmark of the true poet to take such everyday realities, in this case, the sighs of a friend on a country walk, and transform them into something so much more. "The Road Not Taken" is all about what did not happen: This person, faced with an important conscious decision, chose the least popular, the path of most resistance. He was destined to go down one, regretted not being able to take both, so he sacrificed one for the other. Ultimately, the reader is left to make up their own mind about the emotional state of the speaker at the end. Was the choice of the road less travelled a positive one? It certainly made "all the difference, " but Frost does not make it clear just what this difference is. What Is the Main Theme of "The Road Not Taken? " The main theme of the "The Road Not Taken" is that it is often impossible to see where a life-altering decision will lead. Thus, one should make their decision swiftly and with confidence. It is normal to wonder what the outcome would have been if the other road, the road not taken, was the road chosen. But to contemplate this hypothetical deeply is folly, for it is impossible to say whether taking the other road would have been better or worse: all one can say is that it would have been different. What Is the Central Message of "The Road Not Taken? " "The Road Not Taken" suddenly presents the speaker and the reader with a dilemma. There are two roads in an autumnal wood separating off, presumably the result of the one road splitting, and there's nothing else to do but to choose one of the roads and continue life's journey. The central message is that, in life, we are often presented with choices. When making a choice, one is required to make a decision. Viewing a choice as a fork in a path, it becomes clear that we must choose one direction or another, but not both. In "The Road Not Taken, " Frost does not indicate whether the road he chose was the right one. Nonetheless, that is the way he is going now, and the place he ends up, for better or worse, was the result of his decision. This poem is not about taking the road less travelled, about individuality or uniqueness. This poem is about the road taken, to be sure, as well the road not taken, not necessarily the road less traveled. Any person who has made a decisive choice will agree that it is human nature to contemplate the "What if... " had you made the choice you did not make. This pondering about the different life one may have lived had they done something differently is central to "The Road Not Taken. " The speaker opts, at random, for the other road and, once on it, declares himself happy because it has more grass and not many folk have been down it. Anyway, he could always return one day and try the 'original' road again. Would that be possible? Perhaps not, life has a way of letting one thing leading to another until going backwards is just no longer an option. But who knows what the future holds down the road? The speaker implies that, when he's older he might look back at this turning point in his life, the morning he took the road less travelled, because taking that particular route completely altered his way of being. What Is the Structure of "The Road Not Taken? " This poem consists of four stanzas, each five lines in length (a quintrain), with a mix of iambic and anapaestic tetrameter, producing a steady rhythmical four beat first-person narrative. Most common speech is a combination of iambs and anapaests, so Frost chose his lines to reflect this: Two roads di verged in a yell ow wood, And sor ry I could not tra vel both This simple looking poem, mostly monosyllabic, has a traditional rhyme scheme of ABAAB which helps keep the lines tight, whilst the use of enjambment (where one line runs into the next with no punctuation) keeps the sense flowing. The whole poem is an extended metaphor; the road is life, and it diverges, that is, splits apart–forks. There is a decision to be made and a life will be changed. Perhaps forever. What Is the Mood and Tone of "The Road Not Taken? " Whilst this is a reflective, thoughtful poem, it's as if the speaker is caught in two minds. He's encountered a turning point. The situation is clear enough - take one path or the other, black or white - go ahead, do it. But life is rarely that simple. We're human, and our thinking processes are always on the go trying to work things out. You take the high road, I'll take the low road. Which is best? So, the tone is meditative. As this person stands looking at the two options, he is weighing the pros and cons in a quiet, studied manner. The situation demands a serious approach, for who knows what the outcome will be? All the speaker knows is that he prefers the road less travelled, perhaps because he enjoys solitude and believes that to be important. Whatever the reason, once committed, he'll more than likely never look back. On reflection, however, taking the road "because it was grassy and wanted wear" has made all the difference, all the difference in the world. What Are the Poetic Devices Used in "The Road Not Taken? " In "The Road Not Taken, " Frost primarily makes use of metaphor. Other poetic devices include the rhythm in which he wrote the poem, but these aspects are covered in the section on structure. What Is the Figurative Meaning of "The Road Not Taken? " Frost uses the road as a metaphor for life: he portrays our lives as a path we are walking along toward an undetermined destination. Then, the poet reaches a fork in the road. The fork is a metaphor for a life-altering choice in which a compromise is not possible. The traveler must go one way, or the other. The descriptions of each road (one bends under the undergrowth, and the other is "just as fair") indicates to the reader that, when making a life-altering decision, it is impossible to see where that decision will lead. At the moment of decision-making, both roads present themselves equally, thus the choice of which to go down is, essentially, a toss up–a game of chance. The metaphor is activated. Life offers two choices, both are valid but the outcomes could be vastly different, existentially speaking. Which road to take? The speaker is in two minds. He wants to travel both, and is "sorry" he cannot, but this is physically impossible. What Is the Literal Meaning of "The Road Not Taken? " Literally, "The Road Not Taken" tells the story of a man who reaches a fork in the road, and randomly chooses to take one and not the other. What Is the Symbolism of "The Road Not Taken? " The road, itself, symbolizes the journey of life, and the image of a road forking off into two paths symbolizes a choice. As for color, Frost describes the forest as a "yellow wood. " Yellow can be considered a middle color, something in-between and unsure of itself. This sets the mood of indecision that characterizes the language of the poem. Frost also mentions the color black in the lines: And both the morning equally lay In leaves no step had trodden black. Clearly, this is to emphasize that both roads appeared untouched, not having been tarnished by the foot of a previous traveler. The poet is the first to encounter this dilemma. What Is the Point of View of "The Road Not Taken? " The point of view is of the traveler, who, walking along a single path, encounters a fork in the road and stops to contemplate which path he should follow. How Do the Two Roads Differ in "The Road Not Taken? " The two roads in "The Road Not Taken" hardly differ. The first road is described as bending into the undergrowth. The second road is described as "just as fair, " though it was "grassy and wanted wear. " At this, it seems the second road is overgrown and less travelled, but then the poet writes: Though as for that the passing there Had worn them really about the same, And both that morning equally lay In leaves no steps had trodden black. So, again, the roads are equalized. Yet, as if to confuse the reader, Frost writes in the final stanza: I took the one less traveled by, And that has made all the difference. With that, we are left to wonder how Frost knew the road he took was the one less traveled by. But Frost likely left this ambiguity on purpose so that the reader would not focus so much on condition of the road, and, instead, focus on the fact that he chose a road (any road, whether it was that which was less traveled by or not), and that, as a result, he has seen a change in his life. Robert Frost is one of the most critically acclaimed American poets of the 20th century, which is a roundabout way of saying you almost certainly studied one of his poems in school. Most likely, it was a short piece called The Road Not Taken- a poem famous for being one of the most misunderstood and misinterpreted poems ever written, and a testament to how twisted the meaning of something can be by taking a quote out of context. Oh, and it also played a small role in the death of the guy it was written about. To begin with, the part of the poem most everyone is intimately familiar is the last three lines: Two roads diverged in a wood, and I— I took the one less traveled by, And that has made all the difference. From this, and this alone, it would seem the protagonist of the poem took the road less traveled by and this positively benefited his life over taking the more commonly trodden path… While poems can have many different meanings to different people, and certainly parts of this particular poem are very much open to interpretation, what cannot be denied is that the central character of this poem unequivocally does not actually take the road “less traveled”. You see, while it may come as a shock to those of us that had a habit of occasionally nodding off in school, the poem has more than just three lines, and the true meaning of (most of) it is fairly obvious if you just read the entire thing all the way through. To wit, the protagonist of the poem goes out of his way to make it clear that the two paths are virtually identical- neither is more traveled than the other. The setup: Two roads diverged in a yellow wood, And sorry I could not travel both And be one traveler, long I stood And looked down one as far as I could To where it bent in the undergrowth; Then took the other, as just as fair, And having perhaps the better claim, Because it was grassy and wanted wear; From this, you might actually think one was less trodden, except for the next line when the traveler explains he was really just casting about trying to find some reason to take one road or the other in the previous lines and that in truth the roads seemed equally traveled: Though as for that the passing there Had worn them really about the same, And both that morning equally lay In leaves no step had trodden black. Of course, one can’t just stand around in a wood all day, so a choice must be made.  With no reason to choose one road over the other, the traveler takes one, then consoles himself that he will simply come back another time and see where the other road goes… before admitting that in this thought he was really just trying to fool himself once again, as he had tried to do previously by attempting to convince himself one path was less traveled than the other: Oh, I kept the first for another day! Yet knowing how way leads on to way, I doubted if I should ever come back. In the end, he states the most famous part of this poem, though including two key lines that are generally omitted when people are quoting the last stanza of this piece: I shall be telling this with a sigh Somewhere ages and ages hence: So, in the end, while he was very clear in the present that the two roads were identical with no real reason to take one over the other, later in life he knew he’d once again fool himself, this time successfully, by instead remembering that one road was “less traveled by” and that this influenced his decision, when in fact he really decided on a whim. Of course, it isn’t wholly clear at this point whether in “ages and ages hence” he is sighing and noting “that has made all the difference” out of contentment- that his reasoning was sound and that he made the correct choice- or regret, that he’d not been able to see where the other path went, perhaps to a better place than the one he chose on that fateful day. It is generally thought that the latter, “regret”, notion is the “correct” interpretation, at least as far as the original intent of the author. Perhaps speculatively backing this up is the fact that the poem is called “The Road Not Taken”, rather than “The Road Less Traveled”, priming the reader to focus on the former, rather than the latter. But is there any actual evidence to support one interpretation over the other, at least as far as Frost was intending when he wrote it (if he had any real intent at all)? Frost would later state of the poem, “You have to be careful of that one; it’s a tricky poem – very tricky” (Letters xiv-xv). Frost also called the poem his “ private jest “.  You see, Frost was well aware that people would misunderstand “The Road Not Taken”. He experienced this fact when he first began sharing it, with everyone taking the poem “pretty seriously”, as he noted after reading it to a group of college students.  He also later stated this was despite the fact that he had been “doing my best to make it obvious by my manner that I was fooling … Mea culpa. ” To delve further into the mystery, we must look into the interesting origin of the poem. According to Frost, the poem was about his very close friend Edward Thomas, a fellow writer and (eventual) poet in his last years who Frost got to know very well during his time in England in the early 20th century. Frost later noted in a letter he wrote to Amy Lowell that “the closest I ever came in friendship to anyone in England or anywhere else in the world I think was with Edward Thomas”. During their time together, Frost and Thomas took to frequently taking “talks–walking”- walks through the English countryside to look for wild flowers and spot birds, and most importantly discuss all manner of topics from politics and the war, to poetry and their wives, and everything in between. Frost later noted that during their random walking about, frequently a choice had to be made over which path to take. Inevitably one would be chosen for one reason or another and after their walks, Thomas would sometimes kick himself for not taking the other path if their walk failed to result in the sighting of anything interesting.  This ultimately caused Frost to quip that Thomas was a person who, whichever road he went, would be sorry he didn’t go the other. When he returned to America, Frost penned the poem as a friendly, humorous jab about Thomas’ indecisiveness, sending an early draft to Thomas titled, “ Two Roads ” in the early summer of 1915. Thomas reportedly misinterpreted it. Frost then explained the poem’s actual meaning, even going so far as saying that “the sigh was a mock sigh, hypocritical for the fun of the thing”. In response, Thomas noted that he felt that Frost had “carried himself and his ironies too subtly” and that I doubt if you can get anybody to see the fun of the thing, without showing them and advising them which kind of laugh they are to turn on. Nonetheless, the poem had an effect on Thomas and not long after reading it, as you’ll soon see, he decided to enlist in the army. This is something of a surprise move as Thomas was not noted for being particularly patriotic, at least in terms of caring one way or the other about the politics of the conflict resulting in WWI. (See: What Really Started WWI) Indeed, he was noted as being an anti-nationalist who despised the propaganda and blatant racism against Germans being thrown about in the British media at the time. He even went so far as to state that his real countrymen were not Englishmen, but the birds. However, during the pairs’ walks, two things occurred to begin making Thomas seriously consider what he’d do if the war was brought to him.  Would he flee for safer shores, or stand and defend his country? One of the events occurred shortly after the start of WWI. Thomas noted in his journal, a sky of dark rough horizontal masses in N. W. with a 1/3 moon bright and almost orange low down clear of cloud and I thought of men east-ward seeing it at the same moment. It seems foolish to have loved England up to now without knowing it could perhaps be ravaged and I could and perhaps would do nothing to prevent it… He later noted, “Something, I felt, had to be done before I could look again composedly at English landscape”. So while up to this point he had been indifferent to the politics behind the war, he now began to consider that it really didn’t matter what the war was being fought over; if the land and all that was on it was directly threatened, it needed defending if it was to be preserved. The second event that influenced his decision was something he often lamented after in letters. This concerned a matter of what he perceived to be cowardice on his part, though most of us might consider that he was being the only reasonable one in the ordeal. During one of Frost and Thomas’ walks in later 1914, they were confronted with a shotgun wielding gamekeeper who told them to leave the area. Frost felt he was fully in his rights to walk the land in question and wasn’t inclined to bugger off, never mind the gun pointed at him. Frost even nearly decided to bring his fists to the gun fight, but put them down after observing Thomas backing away as Frost was escalating the situation. A few more choice words later and the pair parted ways with the gamekeeper.  But this wasn’t the end of it. Frost decided to go find the gamekeeper’s home, and after banging on the door, the gamekeeper answered.  At this point, Frost, no doubt using eloquence befitting a wordsmith of his stature, told the gamekeeper off once again, explaining what would happen if said gamekeeper ever chose to threaten the pair again while they walked. With that said, Frost and Thomas turned to leave. As they were leaving, the gamekeeper grabbed his shotgun and chose his first target as Thomas. Once again, Thomas, reasonably, reacted by trying to exit the situation rapidly without provoking the person who had a gun trained on him. In the end, the pair left unharmed. However, Thomas couldn’t help but dwell on the fact that his friend had not backed down to a shotgun in his face, while he himself reacted the opposite. He became woefully ashamed of what he perceived as his cowardice in the matter. It also wasn’t lost on him that at that very moment some of his other friends were off demonstrating their bravery fighting in the war while he was safe at home. Frost later attributed this feeling Thomas had of his perceived cowardice as the core reason he went to war. Essentially, Frost felt Thomas wanted a do-over and was making another attempt at testing his mettle, this time in France. This brings us back to the poem and the decision Thomas had been long agonizing over.  He had strong thoughts of emigrating to America to come live near Frost, stating, “I am thinking about America as my only chance (apart from Paradise)”, but that he also felt drawn to the war: “Frankly I do not want to go, but hardly a day passes without my thinking I should. With no call, the problem is endless”. Then the poem arrived on his doorstep in the early summer of 1915. And so it was that shortly thereafter in early July of that year, he wrote to Frost telling him of his final decision on which road he’d take: “Last week I had screwed myself up to the point of believing I should come out to America… But I have altered my mind. I am going to enlist on Wednesday if the doctor will pass me”. Today, the poem and its thought provoking lines are generally regarded as being the “final straw” that made Thomas decide to stop brooding over what to do and finally pick a road- finding his courage and enlisting. This came as a surprise to virtually everyone in Thomas’ life due to the fact he was a 37 year old married father of three who, as noted, was staunchly anti-nationalist and otherwise was not required to enlist. The decision cost him his life. On April 9, 1917 during the battle of Arras in France, he was shot in the chest and killed- a death that was seemingly premature. Of course, had he taken the other road, perhaps instead of a bullet through his chest, he may have met with a watery grave if his ship to the states had been sunk. Or perhaps he would have spent many years writing incredible poetry that was the hallmark of the last couple years of his life- happily living and working next to his great friend, Robert Frost. Two decades after that he was forced to have his sister, Jeanie, committed to an insane asylum, where she ultimately died. His daughter, Irma, also had to be committed for mental health issues, ultimately dying in 1967. His son, Carol, committed suicide in 1940. Another of his daughters, Marjorie, died of a fever after giving birth in 1934, at the age of 29. Yet another daughter, Elinor, died when she was just three days old. His wife died in 1938 of heart failure following breast cancer. In the end, Frost, who died in 1963, outlived his wife by a good margin as well as four of his six children. Expand for References.
